1. Medical Disclaimers & Liability Cap

  • Not Medical Advice: The Longevity 21 website content, product descriptions, and reviews are for informational purposes only and do not replace professional medical advice, diagnosis, or treatment.

  • FDA/Regulatory Warning: Statements regarding our vitamins, minerals, and amino acids have not been evaluated by the FDA or local regulatory bodies, and products are not intended to diagnose, treat, cure, or prevent any disease.

  • Consultation Clause: Customers must consult a healthcare professional before starting any supplement regimen, especially if they are pregnant, nursing, taking medication, or have a medical condition.

  • Strict Liability Cap: Maximum liability is explicitly limited to the exact purchase price of the specific product causing the issue.

2. User-Generated Content & Health Claims

Allowing reviews means users might post unverified health claims (e.g., "This cured my illness"), which can violate advertising laws.

  • Content License: By posting reviews, comments, or photos, users grant Longevity 21 a perpetual, royalty-free, worldwide license to use, modify, and publish that content.

  • Prohibited Health Claims: Users are expressly prohibited from posting medical claims, misleading health advice, or fraudulent reviews.

  • Right to Moderate: Longevity 21 reserves the absolute right to monitor, edit, reject, or delete user reviews at your sole discretion, without notice, to comply with truth-in-advertising laws.

  • No Endorsement: User reviews reflect individual experiences and do not represent the views, testing, or endorsement of Longevity 21.

3. International Sales, Compliance, and Customs

Selling healthcare supplements globally requires shifting the legal burden of local regulatory compliance to the buyer.

  • Import Compliance: The buyer is solely responsible for ensuring that the vitamins, minerals, or amino acids they purchase are legal to import and consume in their destination country.

  • Customs Seizures:  Longevity 21 not liable for packages delayed, confiscated, destroyed, or returned by international customs officials due to local ingredient bans.

  • Duties and Taxes: The customer is the "importer of record" and must pay all destination customs duties, import taxes, and brokerage fees.

  • Territory Restrictions: Longevity 21 reserve the right to restrict or ban sales to specific countries or geographic regions at any time without prior notice.

 

4. Terms of Sale and Age Verification

Supplements require extra guardrails regarding who can buy them and how they are ordered.

  • Age Affirmation: Longevity 21 require users to affirm they are at least 18 years old (or the legal age of majority in their jurisdiction) to purchase supplements from your site.

  • Purchase Limits: Longevity 21 reserve the right to limit order quantities per person, household, or order to prevent unauthorized commercial reselling or automated bulk buying.

5. Auto-Ship Subscription and Recurring Billing

Longevity 21 must comply with the US Federal Trade Commission (FTC) Restore Online Shoppers’ Confidence Act (ROSCA) and state-specific automatic renewal laws (like California's ARL). [1]

  • Continuous Subscription: By signing up, the customer authorizes a recurring charge at the specified interval (e.g., monthly) until they cancel. 

  • Affirmative Consent: Checking the subscription box at checkout constitutes an "electronic signature" agreeing to recurring charges.

  • Cancellation Window: The buyer must cancel 3 business days before the next scheduled ship date to avoid being charged for that cycle

  • Price Changes: Longevity 21 reserves the right to change subscription pricing, but commits to giving customers a minimum notice period (e.g., 30 days) before the change takes effect.

6. Third-Party Fulfillment & Shipping Disclaimer

Since Longevity does not control the physical warehouse or shipping carriers, we are required limit our liability for their mistakes. 

  • Independent Contractors: Fulfillment centers (e.g., ShipBob, Amazon FBA) and carriers (e.g., USPS, UPS, FedEx) are independent entities, and we are not liable for their operational failures. 

  • FOB Shipping Point (Risk of Loss):  The risk of loss passes to the consumer the moment the product leaves the third-party fulfillment center. 

  • Delayed or Lost Shipments: Longevity 21 is not liability for transit delays, lost packages, or severe weather delays caused by the fulfillment provider or carrier. 

  • Damaged Goods:  Customers must report items damaged to Longevity 21 within the first 48 hours of delivery during third-party transit, requiring photographic proof.

7. US Regulatory and Jurisdiction Clauses

Operating from the US requires specific legal hooks to keep potential lawsuits manageable.

  • Governing Law & Venue: Longevity 21 is incorporated and located in Arizona and Arizona Law is to govern the contract.

  • Mandatory Individual Arbitration: All disputes to be settled via individual arbitration rather than court trials.

  • Class Action Waiver: The customer waives their right to participate in a class-action lawsuit against Longevity 21, their employees and affiliates.

  • FDA Compliance Note:  All product pages carry the mandatory FDA boilerplate disclaimer: These statements have not been evaluated by the Food and Drug Administration.
